Terms of Service

1. Acceptance of Terms

By accessing or using GigsUp ("the Service"), operated by GigsUp Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

GigsUp is an AI-powered career matching platform that helps users discover career paths aligned with their values, interests, skills, and identity. The Service includes:

  • The VISI Assessment (Values, Interests, Skills, Identity)
  • AI-generated career match recommendations
  • Resume analysis and skills gap identification
  • Job matching and market insights
  • Development recommendations and career pathways

3. Account Registration

To use certain features of the Service, you must create an account. You may register using an email address and password or through a third-party provider (Google or LinkedIn). You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

4. Subscription Plans and Payments

GigsUp offers the following subscription tiers:

  • Discover (Free) — Limited access including VISI snapshot, career match previews, and resume summary
  • Explore ($5.99/month) — Full VISI results, all career matches, detailed resume analysis, and development recommendations
  • Decide ($10.99/month) — Everything in Explore plus all job matches and expert mentor connections

Paid subscriptions are billed monthly or yearly through Stripe, our third-party payment processor. By subscribing, you authorize us to charge the applicable fees to your payment method on a recurring basis until you cancel. Prices are in USD and may be subject to change with notice.

5. Cancellation and Refunds

You may cancel your subscription at any time through the Stripe Customer Portal. Upon cancellation:

  • Your subscription will remain active until the end of the current billing period
  • You will not be charged for subsequent periods
  • Your account will revert to the free Discover tier

Refunds are generally not provided for partial billing periods. If you believe you have been charged in error, please contact us.

6. User Content

You retain ownership of all content you submit to the Service, including resumes, assessment responses, and profile information. By submitting content, you grant us a limited, non-exclusive license to process, analyze, and store your content solely for the purpose of providing the Service to you.

You are responsible for ensuring that your content does not violate any applicable laws or third-party rights.

7. AI-Generated Content Disclaimer

Career recommendations, resume analyses, and other insights provided by the Service are generated using artificial intelligence and are intended for informational purposes only. They do not constitute professional career counseling, employment advice, or guarantees of employment outcomes. You should use your own judgment and seek professional advice when making career decisions.

8. Intellectual Property

The Service, including its design, features, VISI assessment methodology, and all associated content, is the property of GigsUp Inc. and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

9. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Create multiple accounts to abuse free-tier features
  • Scrape, crawl, or use automated means to access the Service

10. Limitation of Liability

To the maximum extent permitted by law, GigsUp Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. You may delete your account at any time through your account settings, which will permanently remove your data from our systems.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
